NOTICE OF PUBLIC HEARING
REGARDING ESTABLISHMENT OF THE
FEATHER RIVER RECREATION AND PARK DISTRICT
COMMUNITY FACILITIES DISTRICT NO. 2022-01
(PARK MAINTENANCE) AND FUTURE ANNEXATION AREA
NOTICE IS HEREBY GIVEN that the Board of Directors (“Board”) of the Feather River Recreation and Park District (“District”), California, will hold a Public Hearing on November 15, 2022, at 5:00 p.m., or as soon thereafter as the matter may be heard, at the Feather River Recreation and Park District located at 1875 Feather River Blvd. Oroville, CA 95965, to consider the establishment of Feather River Recreation and Park District Community Facilities District No. 2022-01 (Park Maintenance) ("CFD”) and Future Annexation Area. On September 27, 2022, the Board adopted Resolution 1996-22 entitled “Resolution of Intention to Establish Community Facilities District 2022-01 and Future Annexation Area”, (“Resolution of Intention”), pursuant to the Mello-Roos Community Facilities Act of 1982, as amended, commencing with § 53311 of the California Government Code (“Act”). At the Public Hearing, the testimony of all interested persons or taxpayers for or against the establishment of the CFD and the Future Annexation Area, the extent of the CFD and the furnishing of the Services, will be heard. If a majority protest against the establishment of the CFD is filed, as determined in accordance with § 53324 of the Act, no further proceedings to create the CFD or to authorize the Special Tax shall be taken for a period of one (1) year from the date of the decision of the Board. If the majority protests are only against the furnishing of a specified type or types of services within the CFD or portions of the Special Tax, those services or that portion of the Special Tax shall be eliminated. If the Board determines to establish the CFD and proposes to levy the Special Tax, the Board will submit the levy of the Special Tax to the qualified electors of the CFD. The vote will be by the landowners of the CFD with each landowner having one vote for each acre or portion of an acre of land owned within the CFD. The election will be conducted by the District Clerk in conformance with the provisions of § 53326 of the Act and pursuant to the provisions of the California Elections Code, insofar as they may be applicable. The election will be conducted as a mail ballot election. Reference is made to the Resolution of Intention on file in the office of the District Clerk for detail about the extent of the CFD, the Services, the Special Tax, the protest proceeding, and the proposed voting procedure. A copy of the Resolution of Intention and the associated staff report are on file and available for public inspection in the office of the District Clerk.
